Well, if it was in the park, the park is allowed to have their own regs, and they may, I'm not sure.

But according to the fish commission, the entire drainage is all tackle C&R, and bait is allowed.
 
Valley is an all tackle stream. If you read the signs along the stream, it doesn't say anything about what tackle you can or cannot use. It just says that the trout aren't safe to eat, and they must be returned to the stream. If there were tackle restrictions on Valley, the signs would have said so.

Either way, throwing rocks at people, their cars or spouses wether poaching or fishing legally is not something anyone should be doing.
WCO's are there for a reason.

From the National Park Service's webpage on Valley Forge National Historical Park...#3. Not sure if their regs or the PFBC's trump, but just a heads up. I'd imagine a park ranger would enforce their no live bait rules though, whereas a WCO may not.

Edit: Obviously this only applies to the Nat'l Park. No question on sections of stream outside of the park it's C&R all tackle.

In addition...from the PFBC's C&R All Tackle reg page...

"Valley Creek – at Valley Forge and tributaries including Little Valley Creek. Be aware that Valley Forge National Historic Park has imposed special bait restrictions. Check local posters."

Not sure what the NPS posters say, and if they're posted properly, but this would lead me to believe the PFBC is on board with enforcing the Park's regs.
 
Wow. I guess I was part correct. Confusing, but I remember having spoken with a guy who said it wasn't kosher to dunk bait. Is it OK to throw rocks at them in the park?
 
Okay to throw rocks at mountain lions,abominables and Jerseyites.All other targets should be considered individually.
 
The PFBC rule would apply everywhere. C&R, no restriction on bait. And they would enforce that.

Landowners are permitted to create their own rules, on their land only of course. They can't permit something the PFBC doesn't permit, but they can place increased restrictions. If they do so, then it is their responsibility to properly inform the public and enforce those restrictions, and violation would be considered a trespassing offense, not a violation of game laws. I do not know whether the Park Service has come to an agreement with the PFBC regarding bait, so I don't know whether a WCO would take any action on someone fishing bait. I'm guessing no, but he might inform a park ranger, who would take action.

Either way, the bait restriction would only apply on Park lands.

And either way, no, I do not suggest throwing rocks at anybody! 🙂
 
PFBC would have no say vs the National Park Service. Federal government trumps the Commonwealth. Supremacy Clause, US Constitution.
 
But again, pcray is right in that they still have to enforce, and I don't know that they do or don't.
 
Thread has been locked. There has been too much flirting with the issue we have determined has no place in this forum. Sorry. There were some good comments related to the actual report, but it is now over and done. Please try not to retaliate, complain or find work-arounds. If you step back, you will see that it is not productive. Both myself and fishidiot tried to explain this earlier, but it seems that was not sufficient to curb the disturbance.
