Look at the Pennsylvania code where pa laws reside. Public highway is owned by the state unless the land was deeded prior to the becoming a public highway. Look at Little J case. Same law. It is the same thing as someone claiming they own a section of Rt 80.

There were certain criteria established for each stream when it came to commerce, trade and travel. These laws were written back in the William Penn days so they vary. From what I have seen and heard Fishing Creek was deemed non-navigable water.

We could argue high/low water marks but as soon as you step out of the creek you are on my property regardless...I would bet the legal system would probably always side with the landowners view especially if the individual did not ask permission to be there in the first place..

SBecker - Stop in if you get up that way. Park there at my house and enjoy the fishing. There is plenty of trout up and down the stream.

Have you ever explored the water above Camp Levigne? I walked about a mile or so above the campsite from the bridge and didn't see any fish. I did this a few times with no luck. Wondering how productive stream is above the camp.

Be careful of that. There's a private property line up there somewhere.

Is anyone still going out on Fishing Creek in the fall. I went out this past weekend and used a variety of nymphs since I could not see anything rising. All I caught were chubbs. No trout in sight.
