East Branch Brandywine DH Landowner

In today's society, being right doesn't always give you the right...

You can do what you want...

However, considering Clams de-escalated the entire threat by walking away makes me pretty confident from this armchair to speculate he would have been the loser in this situation if he pulled a gun on this nut case.

In the meantime...

I once had a somewhat similar situation on a stream I frequent when a friend was challenged by a landowner when he was LEGALLY fishing on the side of the creek owned by others.

When I got home, I reviewed the county parcel maps that showed the aggravated party possibly didn't even own to the center-line of this stream. I then contacted the other owner (a real estate company) and was assured I could fish there and that they owned the property.

I gave the information to the county WCO who called me back to say he verified the information, the other landowner was a known bluffer and he was headed out to his home to straighten out the situation.

That was 10+ years ago, I fish there all the time and have never had a problem since...

I'm not saying this fix would work in this situation, but at minimum I'd call the WCO for the region and tell him/her the story.
Do PFBC WCO’s have the authority to enforce trespass laws? I’m not sure that having someone with no legal authority to enforce said law, is the best person to be lecturing people on it.

Up until a few years ago, the game commission didn’t have the authority.

That is pretty good sarcastically speaking. I REALLY appreciated this nugget: "Appellant acted pro se at the hearing and presented no evidence. He wished to testify, but he refused to take an oath swearing or affirming that he would tell the truth."
Whenever I see people who choose to act pro se in legal issues, that tells me everything I need to know. They think they're smart, but they're not. There's a reason lawyers cost a lot of money - because they know what they're doing!

It doesn't sound like the juice is worth the squeeze with this issue. It's such a small stretch of marginal water that it really seems like the best policy is to just bypass it from the other side of the creek. I get it that it could be tempting to call him out on his BS about "owning the whole creek", but it's certainly not worth getting shot over. For that matter, nothing related to fishing is worth getting shot over, and this guy sounds like a loose cannon!

I had an encounter with this person yesterday 5.25.2025. it was almost an identical encounter as yours. He ran down his little hill, threw rocks in the water in front of me, said he was going to sue me for everything for trespass and take my fishing license away. He then crossed the stream and ran right up to me getting 6" away from my face. I stared right back and then called the police. They are all too aware of this guy from what I gathered. I have left a message with fish and game to discuss the situation with them, as directed by the police officer. So. That was a disappointing end to a good day on the Brandywine

cyfac --- thats a horrible story, and you did right thing getting the hail out of there. its not worth it -- and dont let it stay on your mind - you had a good day otherwise --- and thats that. forget that section, and that guy.

i like to think of and remember situations like this ... i travel a long way now to fish my favorite Pa. streams - that i have fished for over 40 years now. one famous stream ... along it there is a landowner with a neat and tidy section of the stream. there are lawnmowers set up outside - the owner is retired and refurbishes small engines and sells the lawnmowers as a hobby. one morning i parked a ways away and was walking past and the owner was outside - so i waived and said goodmorning - he waived back and asked me how the fishing was. so we stopped in his driveway and chatted for a long while . his little shop had all these Penn State football posters, old season schedules .... we talked PSU football, the Paterno years, he blasted me for being a Buckeye fan, Briggs vs Techumseh, etc etc. he said " got to take the wife into town ... look - whenever your here, you just park your truck over there by my little barn ... and fish here whenever you want, i'll remember your out of state plates". and off he went.

that Gentleman --- and situations just like that --- are 99.99999999% of the nice encounters ive had while fishing and hiking your beautiful commonwealth. Some of these folks ive had the pleasure to have become very good friends. i'm old now --- i enjoy meeting folks like this as much as i do the actual fishing. guys like the one on Brandywine ... turn and " shake the dust off your sandals " ... or your new Dave Kile approved Orvis Pro wading boots!

According to publicly-available property records none of the creek is his property. The area between the blue lines is unowned.

Some fisherman from the area needs to bring their cop friend along with them next time they fish it and turn the tables on that jerk.

Unowned property? Hard to believe that.

If that is actually the case then PFBC should have an easy time shutting this guy down from chasing people out. You would think givin the history they would have actively remedied this by now if it was as easy as property lines.

The site I search shows the same thing. That stretch of creek adjacent to his property is a pretty well known meat hole and get fished all the time. There's going to be an issue at some point with this guy.

The Chester County Parcel Map shows the creek channel as a separate entity with "ownership" implied as Uwchlan Township which I doubt is correct either.

Maybe folks who care should contact the township for clarification. They WILL know the property boundaries.

It was and is my understanding the township owns the property.

What is strange is the next parcel to the west that is in East Brandywine Township shows the stream & adjacent property on both banks with an implied ownership of East Brandywine Township.

I never seen this kind of thing on other county parcel maps so I have a feeling we/I may be misinterpreting the "boundary lines.

Why speculate...?

Well as far as myself, I'm not speculating. The side the anglers are on, the far side from in front of his house, is owned by Uwchlan Township. They have been asked multiple times.

Yea, but the map implies something different and that leads people to speculate as recently as this morning that the guy has NO ownership rights...

Maybe but nearly every angler reports him harassing them when they are on the opposite side. Some like in the above accounts, he crosses the creek to get to them.
He has zero rights over there 🤷
