Great News! I am trying to get confirmation of this decision from someone who would know. Not that I don't trust Tim, but he didn't identify his source.

Jack: I have always had a lot of respect and admiration for Judge Kurtz and kind of thought that he would decide in favor of the general public. I will be sure to thank him next time I see him. He is a good man.

Jack: I feel that the Judge would not want his email to be public, but is there a way we could thank him via the www??

Best news I've heard for a while!
When this thing dragged out as long as it has, I was getting some doubts about the outcome.
But common sense and right have prevailed

Not only didn't he identify his source...he didn't even post the article.

I am elated and anxous at the same time over this news...It will be interesting to see what the backlashes will be. Although I am in favor of public domain, I hope other landowners will see the legality and fairness of this decision and not be swayed by the campaign sure to be waged by the PLO.

We'll see how it goes. I for one am not in the camp that the sky is falling over private property fishing access. I only hope there is a net gain over all of this.

Maurice

Would be great if Don Beaver lets some of his leased stretches on the River open to the public!

One of the Chief Counsels of the involved agencies confirmed that the verdict is rendered in favor of the Commonwealth. So, Tim was correct. I don't think writing to the Judge to thank him is appropriate, but if thanks are expressed for his thoughtfulness and fairness in, say, a public Letter To The Editor, he would likely be gratified immensely. Might want to wait until the decision is public, though, just to make sure he was actually "thoughtful" and "fair."

Dear Jack,

The initial post that started the thread that Little J linked to was made by an attorney who was involved in the case. I fully understand your scepticism about the source.

Regards,
Tim Murphy

It's for real, according to the AP and the Centre Daily Times.

I'm not surprised, I always thought it was a slam dunk, but it's great news.

LiitleJ named you as the source. I opened the link and assumed I was reading your post. I didn't even notice it was signed by "Craig." Still, even Craig didn't say how he knew. Many of you at that Board probably already knew he was involved, so he didn't feel the need. Anyway, I've seen things be inaccurately reported in the past and before you know it, half the internet has it wrong, so I was just trying to suggest caution until it could be confirmed.

Excellent news!

This has not been a good 7-8 months for the property rights movement in PA. This past August, US Claims court ruled in favor of the gov't in the original land use case that brought the Pa. Landowners Assoc. into being.

After nearly 20 years of litigation and puffery, one of the longest Joan of Arc acts in history may finally be over...

Dear Jack,

I was just busting on you a bit and couldn't resist putting in the "lawyer" shot.

You are of course correct, the people from here who don't visit that message board would have no way of knowing Craig or his involvement in the case.

Regards,
Tim Murphy
