Looks like this would apply to the upper and possibly middle Delaware River. There is a map attached to the article which implies this would only impact the Pa portions of the drainage area. It would seem the obvious target is the drilling industry.

Despite the didymo, which is only found in very clean cold water, it may still qualify. But you can expect it to take a long time for a decision to be made.
